Our response to issues on "the sanction on Indonesian
migrant workers insurance provided by Asuransi Jasindo"

Allow us on this occasion to thank Harian Jurnal Nasional for its news coverage
on 3 July 2007 and to provide cover for both sides as follows:
1. Following a selection conducted by the Minister of Manpower and
Transmigration, PT. Asuransi Jasa Indonesia (Persero) as a state-owned company,
dealing with general insurance has been assigned as Head of the Indonesian
Workers Insurance Consortium (hereinafter called Asuransi Jasindo Consortium)
in compliance with the Decree of the Minister of Manpower and Transmigration No.
KEP.280/MEN/VII/2006 dated 21 July 2006.
2. Asuransi Jasindo Consortium has, in compliance with the Decree of the
Manpower and Transmigration Department No. KEP.280/MEN/VII/2006 dated 21 July
2006, carried out its tasks properly as an organizer of Indonesian workers
insurance activity since its appointment to date in accordance with prevailing
regulations, and this has been proven by the fact that no complaints have so far
been filed by the insured workers.
3. Referring to the implementation of the Consortium’s tasks as stated in point
2 above, the Indonesian Minister of Manpower and Transmigration through
Minister’s Decree No. B.120/MEN/SJ-HK/IV/2007 dated 25 April 2007 on the
evaluation of the Consortium’s performance as Indonesian workers insurance
program organizer has conveyed his evaluation on the Consortium’s performance
and given the Consortium one month for corrective action.
4. The Consortium had in less than a month responded to the Decree of the
Minister mentioned in point 3 above, through a letter sent by Asuransi Jasindo
No. SRT.283/DMA/V/2007 dated 16 May 2007 addressed to the Minister of Manpower
and Transmigration, with a copy to BNP2TKI, in which Asuransi Jasindo explains
the Consortium’s performance and their corrective action.
5 In response to Asuransi Jasindo’s Consortium letter indicated in point 4
above, the Indonesian Minister of Manpower and Transmigration gave his response
as displayed in Harian Bisnis Indonesia dated 29 May 2007, mainly stating that
the Consortium had managed to improve their operational service within the time
allocated, thus not necessitating the Government to impose administrative
sanction on the Consortium.
6. BNP2TKI through their letter No. B.385/BNP2TKI/VI/2007 dated 28 June 2007
instructed Jasindo Consortium to discontinue its function as an organizer of
Indonesian workers insurance activity for an unspecified time.
7. Based on the explanation stated in points 1 to 5 above, Asuransi Jasindo as a
state-owned company fully owned by the government doesn’t feel compelled to
comply with BNP2TKI’s instruction as Asuransi Jasindo Consortium has to this
date fully adhered to prevailing regulations.
8. From the above explanation it was also learned that Asuransi Jasindo had
never received any instruction from BNP2TKI as was reported in Harian Bisnis
Indonesia dated 2 July 2007 saying that BNP2TKI had sent a letter No.
B.327/BNP2TKI/VI dated 7 June 2007 asking Asuransi Jasindo to make the necessary
improvements within two weeks time. According to our records the letter with the
same content as mentioned above had been sent by fax No.5229124 dated 3 July
2007 at 1:38 AM, 5 days after the Letter No. B.385/BNP2TKI/VI/2007 was issued.
9. It may be worth mentioning that up to May 2007, 588,946 Indonesian migrant
workers had become Jasindo policy holders, contributing IDR 129,181,000,000
gross premium to Asuransi Jasindo, from which 4828 claims worth IDR
14,437,000,000 had been filed and settled, the claim ratio being 11.18 %, while
the remaining 1418 claims are being processed.
10. What BNP2TKI has revealed through the media that Jasindo Consortium didn’t
perform well in carrying out workers insurance program is in our opinion
groundless, necessitating us to provide cover for both sides. Furthermore,
Asuransi Jasindo has in this context requested BNP2TKI to conduct an audit on
the Consortium’s performance. We can firmly say that Jasindo’s financial
performance has been sound, looking at its condition as of May 2007, wherein
Jasindo’s gross premium stood at IDR 1,054,784,000,000, gross claim IDR
564,026,000,000 and total assets reached IDR 1,577,309,000,000.
We are hereby attaching a letter from an association of Indonesian Migrant
Workers Providers stating that Jasindo Consortium has rendered good and fast
services to overseas workers. We do hope our explanation is sufficient to
present both sides of the various issues on Asuransi Jasindo Consortium
available in the media , and we sincerely thank Harian Rakyat Merdeka for their
positive comments and for their continued cooperation.
